Distance Contract / Conditions of Purchase
Purchase conditions:
In order to avoid unnecessary delays and disagreements during the conclusion of the Purchase Contract, please read and accept the attached most important documents of SIA “Ambergs”, united reg. No. 40003291554 (hereinafter referred to as “AMBERGS”) terms and conditions / distance contract.
1. TERMS
1.1. The Seller – SIA “Ambergs”, a company established and operating in accordance with the legislation in force in the Republic of Latvia, registration No. 40003291554, registered office at Brīvības gatve 195-20, Riga, LV-1039, Republic of Latvia, VAT No.
LV40003291554.
1.2.
Pircējs – fiziska persona, kura iegādājas preces un/vai pakalpojumus Veikalā vai lieto Veikalu, kura ir sasniegusi 18 gadu vecumu un plāno iegādāties preces un/vai pakalpojumus.
1.3.
Veikals – interneta veikals “AMBERGS”, kas ir pieejams tīmekļa vietnē www.ambergs.lv.
1.4.
Pirkšanas–pārdošanas līgums – Pircēja un Pārdevēja noslēgta vienošanās par Veikalā pieejamo preču pirkšanu–pārdošanu.
1.5.
Preču izsniegšanas vieta / Noliktava – vieta, kur izsniedz (saņem) AMBERGS preces, atrodas Brīvības gatve 195-20, Rīga, LV-1039, Latvijas Republikā.
1.6.
Noteikumi – šie attālinātas pirkšanas–pārdošanas noteikumi, kas nosaka Pārdevēja un Pircēja pienākumus un tiesības, Pārdevēja piedāvāto preču un/vai pakalpojumu iegādes un apmaksas nosacījumus, preču un/vai pakalpojumu piegādes un atpakaļatdošanas procedūru un līgumslēdzēju pušu atbildību, kā arī regulē citus ar preču un/vai pakalpojumu pirkšanu un pārdošanu Veikalā saistītos jautājumus.
2. GENERAL RULES
2.1.
These Terms and Conditions are a legally binding document and set out the mutual rights, obligations and responsibilities of the Buyer and the Seller and other terms and conditions relating to the purchase and sale of goods and services offered by the Seller when purchasing goods and/or services from the Shop.
2.2.
The Buyer may purchase goods and services from the Shop only by accepting the Terms.
By acknowledging that he/she has read the Terms and Conditions, the Buyer undertakes to comply with them and to act in accordance with them.
By purchasing goods and/or services from the Shop, the Customer agrees to be bound by the Terms and confirms that he/she understands them.
If the Terms have not been read and/or understood, or the Customer does not agree to them, the goods and/or services cannot be purchased.
2.3.
The Seller has the right to amend the Terms.
Amendments to the Terms shall come into force when they are published on the Shop.
If the Buyer uses the Shop after the amendment to the Terms has been published, the Buyer shall be deemed to have consented to all amendments to the Terms.
3. ENTRY INTO FORCE OF THE SALE AND PURCHASE AGREEMENT
3.1.
Purchase of the Goods in the Shop is subject to the placing of an order.
Before placing an order, the Buyer shall read the Shop’s privacy policy.
When the Buyer places an order in the Shop, it is deemed to have read the Privacy Policy.
3.2.
The Buyer places an order by completing a form and providing the data required for the purchase (“Order Placement Data”).
The Buyer is responsible for the accuracy, non-disclosure and/or storage of the Order Data.
3.3.
In order to purchase the Goods, the Customer shall place an order in the Shop by filling in an electronic order form.
3.4.
A Sale and Purchase Agreement shall be concluded for each order placed by the Customer.
3.5.
The Buyer and the Seller shall be deemed to have entered into a Sale and Purchase Agreement when the Buyer:
(i) places an order and creates a basket of Goods in accordance with the Seller’s instructions and specifies the delivery address or the method of collection of the Goods;
(ii) acknowledges that he has read the Terms and Conditions, selects a payment method and pays for the order; and
(iii) the Seller confirms the Buyer’s order by displaying and/or sending order details, a confirmation (by email or telephone) and/or a VAT invoice.
If the Buyer does not accept the Terms in part or in full, the goods and/or services cannot be purchased.
3.6.
The Seller may send further confirmations to the Buyer, such as confirmation that payment has been received, etc.
3.7.
The Sale and Purchase Agreement shall remain in force until the obligations set out in this Agreement have been fulfilled.
The Sale and Purchase Agreement shall be deemed to have been performed when the Goods have been handed over to the Buyer in accordance with the procedure described in the Conditions and the applicable legislation of the Republic of Latvia.
3.8.
The Buyer undertakes to pay for and accept the Goods ordered from the Store upon confirmation of its order.
3.9.
The Seller may not confirm the Buyer’s order if the Buyer has not fulfilled all the conditions for ordering the Goods, if the Seller does not have the Goods the Buyer wishes to purchase, if the Buyer has not confirmed acceptance of the Terms, if the Seller believes that the Buyer is engaged in wholesale purchasing, and/or for other reasons which may be individually disclosed to the Buyer.
4. RIGHTS AND OBLIGATIONS OF THE BUYER
4.1.
The Buyer has the right to:
4.1.1.
To shop in the Shop in accordance with the Terms and Conditions, other conditions of the Seller and applicable legislation of the Republic of Latvia;
4.1.2.
to withdraw from the Sale and Purchase Agreement concluded in the Shop by notifying the Seller in writing within 14 (fourteen) days, in accordance with the procedure described in the Cabinet of Ministers Regulation No 255 “Regulations on Distance Contracts”, adopted in 2014.

4.1.3.
return and/or exchange the Goods of inadequate quality or inadequately assembled and make use of the warranty granted for the Goods;
4.1.4.
exercise other rights in accordance with the Terms and/or applicable laws of the Republic of Latvia.
4.2.
Pircējs apņemas:
4.2.1.
apmaksāt pasūtītās Preces un to piegādi un veikt citus maksājumus (ja tādi norādīti, slēdzot Pirkšanas–pārdošanas līgumu) un pieņemt pasūtītās Preces;
4.2.2.
apskatīt un pārbaudīt Preces, tās pieņemot, un informēt Pārdevēju par bojājumiem, acīmredzamiem defektiem un modeļa vai montāžas atšķirībām no tā, ko Pircējs pasūtījis atbilstoši šajos Noteikumos aprakstītajai procedūrai;
4.2.3.
pārbaudīt iegādāto Preču kvalitāti un informēt par to Pārdevēju (zvanot uz tālruņa numuru +371 29460997 vai rakstot uz e-pasta adresi: [email protected]) par Preču trūkumiem, ko nebija iespējams pamanīt, Preces pieņemot;
4.2.4.
pēc Preču saņemšanas veida izvēlēšanās saņemt Preces uzreiz pēc informācijas saņemšanas par to, ka preces ir gatavas saņemšanai;
4.2.5.
izvēloties preču piegādes vai citus Pārdevēja piedāvātos pakalpojumus, nodrošināt to sniegšanai nepieciešamos apstākļus un tos apmaksāt;
4.2.6.
segt Preču atpakaļatdošanas izmaksas, ja paredzēts, ka tās sedz Pircējs;
4.2.7.
nekavējoties atjaunināt informāciju, ja ir mainījušies Pircēja Reģistrācijas dati vai Preču piegādes dati;
4.2.8.
neizmantot Veikalu tā, ka tiek apdraudēta tā pienācīga funkcionēšana un drošība vai ka tiek ierobežota citu lietotāju piekļuve Veikalam;
4.2.9.
ievērot citos noteikumos un spēkā esošajos Latvijas Republikas tiesību aktos norādītās prasības.
5. RIGHTS AND OBLIGATIONS OF THE SELLER
5.1.
The Seller has the right to.
restrict or deny the Buyer access to the Shop without prior notice, as well as cancel the Buyer’s registration, if the Buyer has attempted to harm the stable operation of the Shop and/or has failed to fulfil its obligations; the Seller shall not be liable for any losses caused by the Buyer;
5.1.2.
temporarily suspend or terminate the operation of the Shop, make changes to the Shop or certain parts thereof, change its content in part or in full, restrict purchases in the Shop, change the address of the Shop website without prior notice to the Buyer, change the number of registered Buyers; the Seller shall not be liable for any damage to the Buyer resulting from such actions;
5.1.3.
change the Terms and Conditions, the prices of the Goods, the terms and conditions of purchase of the Goods or other conditions applicable to the Shop by posting the changes on the Shop.
5.2.
Pārdevējs apņemas:
5.2.1.
cienīt Pircēja privātumu un sargāt Pircēja datu konfidencialitāti, izņemot spēkā esošajos Latvijas Republikas tiesību aktos un Veikala Privātuma politikā noteiktos gadījumus;
5.2.2.
Ja Pārdevējs kāda iemesla dēļ nevar pārdot Pircējam pasūtīto Preci, par Preci/pasūtījumu samaksātā summa ir jāatmaksā 7 (septiņu) darba dienu laikā.
6. PAYMENT OF PRICES AND GOODS
6.1.
The price of the Goods is quoted in the Shop and/or on the order in euros, inclusive of value added tax.
6.2.
The price of the Goods does not include delivery charges and charges for services which the Buyer orders from the Seller.
Unless otherwise stated, delivery services and other services shall be paid for separately by the Buyer.
The price of the services and the procedure for calculation and payment shall be reflected in the Shop.
6.3.
Goods may only be purchased in the Shop by prepayment.
6.4.
The documents evidencing the purchase – order confirmation and VAT invoice – are sent to the Customer electronically to the e-mail address indicated in the Customer’s order form; the Customer may download and/or print these documents.
6.6.
If the Seller detects a pricing error in the Shop, the Seller shall immediately notify the Buyer thereof.
6.7.
The minimum amount per order is €5.00 + delivery and/or storage costs.
Orders placed below €5.00 are automatically cancelled and the Buyer must place a new order (online purchase) once this limit has been reached.
7. DELIVERY OF GOODS
7.1.
The possible delivery methods of the Goods are displayed when the Buyer has created a shopping cart and entered the delivery address.
7.2.
Delivery of the Goods is a paid service.

7.3.
If the Buyer chooses the delivery service, the delivery price is displayed at the end of the ordering process, before the payment method is selected and/or payment is made.
The delivery service is prepaid at the time of purchase.
7.4.
The Goods shall be offered to the Buyer within the calendar days specified in the product description of each Good, after confirmation of the order and receipt of payment.
If the availability time is not specified in the product description, the goods shall be made available within 3 working days, after confirmation of the order and receipt of payment.
The Seller cannot guarantee that the Goods will in all cases be delivered in accordance with the Conditions and/or other conditions found in the Shop and that they will be delivered in accordance with the delivery conditions individually specified to the Buyer, in particular if the Goods ordered are not in the Seller’s stock.
The Seller undertakes to use its reasonable endeavours to ensure that the Goods are delivered as soon as possible.
7.5.
When ordering delivery of the Goods, the Buyer shall specify the exact delivery address and ensure that the conditions are suitable for unloading the Goods (unlock the gate, raise the barrier, open the door, etc.).
Delivery of the Goods shall be made only to the front door of the building – no balcony or window may be used for delivery of the Goods.
7.6.
Ja Pircējs nenodrošina Pārdevēja pārstāvim pieeju Preču izkraušanai paredzētajā adresē, kas norādīta Pircēja pasūtījumā, norunātajā Preču piegādes laikā un 20 (divdesmit) minūtes pēc šī laika, tiek uzskatīts, ka piegāde nav bijusi iespējama Pircēja vainas dēļ.
Šādā gadījumā Pircēja iegādātās Preces nogādā atpakaļ veikala noliktavā, un Pārdevēja pārstāvis vienojas ar Pircēju par tuvāko iespējamo Preču piegādes datumu.
Preces uzglabā Preču izplatīšanas vietā līdz minētajam datumam, taču ne ilgāk par 4 kalendārajām dienām.
Ja Pircējs vēlas, lai Pārdevējs piegādātu pasūtītās Preces atkārtoti, Pircējs apmaksā Pārdevējam atkārtoto Preču piegādi, atkārtoti vienojoties par piegādes dienu, atbilstoši tarifam, kāds bijis spēkā Preču pirmreizējai piegādei.
7.7.
Pieņemot Preces, Pircējs pārliecinās par piegādes stāvokli un Preču daudzumu, kvalitāti un komplektāciju.
7.8.
Ievērojot neatbilstības preču kvalitātē un/vai komplektācijā, Pircējs nevar pieņemt preci, kuras kvalitāte un/vai komplektācija ir neatbilstoša.
Pircējam ir jāinformē pārdevējs par problēmu.
7.9.
Ja Pircējs pieņem piegādātās Preces bez komentāriem, tiek uzskatīts, ka tās ir piegādātas nebojātā iepakojumā un ka Preču daudzums, kvalitāte un komplektācija atbilst Pirkšanas–pārdošanas līguma nosacījumam.
Uzskatāms, ka ar pārdošanu saistītie pakalpojumi un Preču piegāde veikti atbilstoši.
7.10.
Pircējs apņemas pieņemt preces personīgi.
Piegādājot Preces, Pircējam var prasīt uzrādīt personu apliecinošu dokumentu un informāciju par pasūtījumu, kuru Pārdevējs sūtījis Pircējam.
7.11.
Kad Preces ir nogādātas uz Pircēja norādīto adresi, tās tiek uzskatītas par nodotām Pircējam neatkarīgi no tā, vai tās ir pieņēmis pats Pircējs vai cita persona, kas tās pieņēmusi norādītajā adresē.
Ja Pircējs nav varējis pieņemt Preces pats, bet Preces ir piegādātas norādītajā adresē, Pircējam nav tiesību sūdzēties Pārdevējam par Preču piegādāšanu nepareizajai personai.
Ja Preces netiek piegādātas plānotajā piegādes datumā, Pircējs par to nekavējoties informē Pārdevēju – ne vēlāk kā nākamajā dienā pēc plānotā piegādes datuma.
Pretējā gadījumā Pircējs zaudē tiesības sūdzēties Pārdevējam par piegādes kavēšanos un/vai par Preces nepiegādāšanu.
7.12.
Pārdevējs nav atbildīgs par Preču piegādes noteikumu pārkāpumiem, ja Preces nav piegādātas Pircējam vai ir piegādātas novēloti Pircēja vainas dēļ vai tādu apstākļu dēļ, kurus Pircējam būtu iespējams novērst.
8. RECEIPT AND STORAGE OF GOODS
8.1.
If the Buyer does not order a delivery service, the Goods ordered may be collected free of charge from the warehouse.
When placing an order, the Buyer shall select the location at which it would like to receive the Goods ordered.
8.2.
When the Goods ordered are ready for collection, the Buyer will receive a confirmation message that it is possible to collect the Goods.
On arrival at the point of issue / warehouse to collect the Goods ordered, the Buyer shall present to the Seller’s representative a valid form of identification as well as the order confirmation message sent electronically by the Seller to the Buyer.
If the Buyer is unable to produce the said documents, the Seller shall have the right to refuse to deliver the Goods to the Buyer.
8.3.
The Buyer shall receive the Goods ordered no later than 4 (four) days after the Seller has informed the Buyer electronically that the Goods are ready for collection.
8.4.
Once the Buyer has received the Goods, they shall be deemed to have been issued (delivered) to the Buyer.
8.5.
If the delivery method chosen is Omniva Parcel.
Goods are delivered to Omniva parcel machines at an additional charge.
The Buyer must receive the Goods within 6 (six) days of being notified by Omniva that the Goods are ready for collection.
If the Buyer does not receive the Goods within the time specified, in such case the Goods purchased by the Buyer shall be returned to the store and the Buyer shall forfeit the shipping costs.
8.6.
Courier.
Goods are delivered by courier at an additional charge from 10.00 a.m. to 5.00 p.m.
The delivery is subject to a surcharge of 08:00 to 20:30, without the possibility to choose the preferred delivery time.
Courier delivery is made without prior appointment on the working day.
Delivery is only to the front door of the home at the address you have specified in your order.
Goods are not delivered to places where vehicles are not allowed to stop.
In these cases, please indicate on your order the nearest place where stopping is possible.
It is the buyer’s responsibility to collect the goods on delivery.
If the Buyer does not receive the Goods at the time of delivery, in such case the Goods purchased by the Buyer shall be returned to the store and the Buyer shall forfeit the shipping costs.
9. QUALITY AND GUARANTEE
9.1.
The general characteristics of each Good to be purchased are set out in the description of that Good.
In the event of any difference or inconsistency in the characteristics of the Goods as set out in the title or description, the information set out in the description of the Goods shall be deemed to be correct.
9.2.
The colour, shape and other characteristics of the Goods displayed in the Shop may differ from the actual colour, shape and size of the Goods due to the electronic devices used by the Buyer or other technical reasons; differences in external appearance should also be taken into account within the limits of reason.
9.3.
Unless otherwise stated in the Shop, the Goods purchased by the Buyer are covered by a standard 2-year warranty.
10. RIGHTS OF REScission
10.1.
The Buyer shall have the right to withdraw from the Purchase and Sale Agreement concluded electronically within 14 (fourteen) days from the date of delivery (receipt) of the Goods without explaining the reason, except for the provisions of the Cabinet of Ministers Regulation No. 255 “Regulations on Distance Contract”, adopted in 2014.

The Buyer may withdraw from the Contract by returning the Goods to the place of distribution of the Goods or by electronically (e.g. by e-mail) sending the Seller information on withdrawal from the Sale and Purchase Contract to the e-mail address [email protected].
The Buyer’s message must clearly state that the Buyer withdraws from the Sale and Purchase Agreement.
The Buyer shall produce proof of purchase (invoice, purchase receipt, etc.) at the place of delivery of the Goods or by sending a copy thereof together with the notice of withdrawal from the Sale and Purchase Agreement, confirming that the Goods have been purchased from the Seller.
If several Goods have been purchased under one Sales Contract, the right of withdrawal shall apply to all the Goods together and to one or more of them.
The conditions set out in 10.2.
and 10.13.
10.2.
The Goods shall be returned to the Seller not later than 14 (fourteen) calendar days after the Seller has been notified of the withdrawal from the contract of sale.
The Buyer shall be responsible for the proper packaging of the Goods when returning them.
The Buyer shall bear the direct costs of returning the Goods, unless otherwise specified by the Seller after receipt of the notice of withdrawal from the Sales Contract.
10.3.
The Goods may be returned to the place of distribution or returned by an intermediary (courier) chosen by the Buyer who shall deliver the Goods to the place of distribution.
Before returning the Goods, the Buyer shall contact the Seller (by calling 29460997 or writing to [email protected]) and agree on the method and address of return.
It is not possible to send the goods by Omniva parcel as we will not receive them in this case.
They must be delivered to the place of delivery.
10.4.
The money for returned Goods shall be refunded to the Buyer when the Goods have been returned to the Seller.
The Buyer agrees that when returning the Goods, the money will be refunded by bank transfer to the bank current account used when payment was made.
10.5. The Seller shall not be deemed to be in breach of the refund conditions if the money transfer cannot be made due to the Buyer’s fault (delayed return of goods, inaccurate data, etc.).
10.6.
In cases of return of goods, the Seller shall not compensate for any additional costs that the Buyer may have incurred by choosing a delivery method other than the cheapest method offered by the Seller.
10.7.
If the Buyer does not like the shape, colour, size, model of the goods, which entitles the Buyer to return the goods, the return of the goods shall be carried out in accordance with the applicable regulations and legislation of the Republic of Latvia.
Certain goods, such as goods without packaging, which are not suitable for return for health or hygiene reasons, as well as services provided accordingly, cannot be returned.
The list of such goods is included in the Cabinet of Ministers Regulation No 255 “Regulations on Distance Contracts”, adopted in 2014.

10.8.
If the Goods purchased are of unsatisfactory quality, the Buyer may require the unsatisfactory quality Goods to be replaced with Goods of satisfactory quality, or return the Goods and recover the amount paid for them.
Goods of unsatisfactory quality shall be exchanged or returned in accordance with these Conditions and the applicable laws of the Republic of Latvia.
10.9.
When returning the Goods, the Buyer shall comply with the following conditions.
10.9.1.
Goods returned must be in their original packaging;
10.9.2.
The Goods and their packaging are free from any damage caused by the Buyer;
10.9.3.
The Goods must be unused, resalable (with labels intact, protective films removed, etc.).
This does not apply to returned Goods of unsatisfactory quality);
10.9.4.
returned Goods must be assembled in the same way as received by the Buyer;
10.9.5.
when returning the Goods, the VAT invoice evidencing the purchase must be presented and the Returns Application Form must be completed;
10.10.
Before exchanging or returning Goods of unsatisfactory quality, or in cases where the Goods are returned for reasons other than those entitling the Buyer to withdraw from the Contract, the Buyer shall contact the Seller (by telephone +371 29460997 or by email [email protected]) and agree the terms of exchange or return of the Goods.
The Buyer may return unsatisfactory quality Goods at the place of issue of the Goods.
10.11.
If the returned Goods are missing parts, damaged or in disorder and/or inadequately packed, the Seller shall be entitled to refuse to accept such Goods and to refund the amount paid by the Buyer for the returned Goods.
10.12.
The Buyer may not return Goods which cannot be returned in accordance with the applicable laws of the Republic of Latvia.
11. LIABILITY OF THE CONTRACTING PARTIES
11.1.
The Purchaser is responsible for the accuracy of the Registration Data.
If the Buyer provides inaccurate registration data and/or fails to update it in a timely manner, the Seller shall not be liable for the consequences.
11.2.
The Buyer is responsible for the transfer of registration data to third parties.
If a third party uses the services of the Shop or purchases goods and/or services in the Shop by logging in with the Buyer’s data, the Seller shall treat that person as the Buyer and the Buyer shall be liable for the obligations arising from such use.
11.3.
The Seller shall not be liable for any loss arising from the Buyer’s failure to read the Terms and/or the Sale and Purchase Agreement against the Seller’s advice and the Buyer’s obligation to read them, even if given the opportunity to do so.
11.4.
If the Seller’s Shop contains links to the websites of other companies, institutions, organisations or individuals, the Seller is not responsible for the information or activities on those websites, does not monitor or control those websites and does not represent those legal or natural persons.
11.5.
In the event of damage, the guilty party shall only compensate the other party for direct damages.
11.6.
The Seller shall not be liable for non-performance of its obligations in relation to the contract of sale and/or non-delivery/delayed delivery of the goods if this is due to the fault of third parties or due to circumstances which the Seller could not foresee or control at the time of conclusion of the contract of sale and was unable to prevent these circumstances or their consequences (force majeure).
If the said circumstances persist for more than 1 (one) month, the Parties may terminate the concluded Sale and Purchase Agreement by mutual agreement.
12. PROVISION OF INFORMATION
12.1.
The Seller shall send all notices and other information to the Buyer at the email address provided by the Buyer.
The Buyer shall be deemed to have received the information 3 (three) hours after sending.
12.2.
The Seller shall not be liable for any disruption of the internet connection or interference with networks or email sites which results in the Buyer not receiving messages from the Seller.
12.3.
The Buyer shall use the contact details set out in these Terms and the contact details set out in the “Contact / Opening Hours” section of the Shop for all communications.
13. FINAL RULES
13.1.
The Buyer shall be deemed to have agreed in writing to all the information provided on the Seller’s website, including these Conditions, information about the Seller, the Goods and Services offered and their characteristics, the procedure regarding the Buyer’s right to withdraw from the contract of sale, the warranty provided by the Seller.
13.2.
The terms and conditions of the Sale and Purchase Agreement concluded between the Buyer and the Seller shall be governed by the laws of the Republic of Latvia in force.
13.3.
Pārdevējs var jebkurā laikā nodot šajos Noteikumos noteiktās tiesības un pienākumus trešajām personām bez Pircēja piekrišanas vai paziņošanas Pircējam.
14.4.
Visas Pircēja un Pārdevēja domstarpības attiecībā uz Noteikumiem risina sarunu ceļā.
Ja līgumslēdzējas puses nespēj atrisināt domstarpības sarunu ceļā 15 (piecpadsmit) dienu laikā, tās risina atbilstoši spēkā esošajos Latvijas Republikas tiesību aktos noteiktajai procedūrai.
13.5.
Pircējs var iesniegt prasības un/vai sūdzības par Veikalā iegādātajām precēm un/vai pakalpojumiem Patērētāju tiesību aizsardzības centram (Brīvības iela 55, Rīga, LV-1010, zvanot uz tālruni +371 65452554, vai rakstot uz e-pasta adresi [email protected], vai Patērētāju tiesību aizsardzības centra tīmekļa vietnē www.ptac.gov.lv, vai aizpildot pieteikumu platformā patērētāju strīdu izšķiršanai tiešsaistē http://ec.europa.eu/odr/.
13.6.
Šie Noteikumi ir spēkā no 2020.
gada 24.
janvāra.
